In the case of separation or divorce between parties who share a companion animal, the interests of the animal are generally assumed to be represented by the individuals involved. However, as in disputes over child custody, the interests of the animal may be lost in the fight for possessions. The best interests of an animal should be considered separately from other property interests. H 5556 would amend the laws governing divorce and separation to allow the court to consider the best interests of the animal.

Allow Interests of Animals to be Considered in Divorce Proceedings

I am writing to ask your support for H 5556, which would allow the court to consider the best interests of the pets involved in custody disputes.

In the case of separation or divorce between parties who share a companion animal, the interests of the animal are generally assumed to be represented by the individuals involved. However, as in disputes over child custody, the interests of the animal may be lost in the acrimonious struggle between the parties for possessions. This bill would allow the court to make an independent determination of what is in the best interests of any companion animals involved, separating them from any agreements affecting inanimate property.
