Under current federal law, it is unlawful to create or distribute “crush videos,” which depict individuals viciously torturing, mutilating, or killing small animals.  However, this law does not include a provision to punish the individuals who are actually abusing the animals. This is generally left to state authorities. The PACT Act closes this loophole by creating a federal offense that would allow charges to be brought against an individual who purposely crushed, burned, drowned, suffocated, impaled or otherwise subjected to serious bodily injury a living mammal, bird, reptile or amphibian if their action occurred in or affected interstate or foreign commerce. The PACT Act would also allow the FBI and U.S. Attorneys to prosecute crimes, such as the drowning of unwanted puppies at puppy mills or abusing animals at travelling circuses, as long as the perpetrators are doing business across state lines.

Support passage of a federal animal cruelty bill

Dear [Decision Maker],

I am writing to ask your support for the Preventing Animal Cruelty and Torture (PACT) Act, S 654/HR 1494. This legislation would allow federal animal abuse charges to be brought against individuals who purposely crush, burn, drown, suffocate, impale or otherwise subject to serious bodily injury a living mammal, bird, reptile or amphibian if their action occurred in or affected interstate or foreign commerce.

This bill would close a loophole in the current crush video law by allowing the FBI and U.S. Attorneys to prosecute cases of extreme cruelty against the perpetrators of the cruelty when they are engaged in interstate commerce. It would provide meaningful penalties for this type of abuse, while exempting veterinary practices, the slaughter of animals for food, hunting and trapping, and scientific research. Charges could be brought against individuals engaged in drowning unwanted puppies at puppy mills that do business across state lines, as well as against those who abuse animals travelling with a circus.
