The Personal Care Products Safety Act is intended to provide
more assurance that ingredients and final products sold as personal care
products, specifically cosmetics, are safe for humans.
However, it includes language that would merely “encourage”
the use of non-animal methods to test for human safety, instead of mandating
the use of human relevant data. It fails to recognize that animal testing does
not ensure human safety and that there are many validated test options that
do—without harming animals.
According to a recent report by a government watch-dog group,
it is the federal government, not industry, that is conducting a majority of
cosmetics safety testing using animals. This must be stopped. Government
agencies are required by the Interagency Coordinating Committee for the
Validation of Alternative Methods to use non-animal test methods once they are
validated by the committee. The government least of all should be relying on
unreliable and inhumane animal tests.
The Personal Care Products Safety Act should amend its
provision to encourage non-animal use and should instead include the language
of the Humane Cosmetics Act (HR 2790) to prohibit the use of live
animals to test cosmetics and other personal care items.

I am writing today in support of legislation to ensure that personal care products, including cosmetics, are safe for human use. However, as currently written, the legislation under consideration (S 1113, the Personal Care Products Safety Act), perpetuates the use of animals to conduct safety testing, without regard to the fact that animal tests are not as predictive, reliable or as cost-effective as non-animal test methods. Therefore, I urge you to support an amendment to this bill to include language that will phase out the use of live animals for cosmetics and personal care products safety testing, as well as the sale of cosmetics tested on animals. Today, all the nations in the European Union, along with many other countries around the world, are adopting laws that will ensure both humane and safe products. As you consider S 1113, I ask that you please push to amend it to include a ban on the use of live animals for cosmetics and personal care testing for any personal care products safety legislation. Requiring human relevant data in considering the safety of cosmetics and other personal care products will result in products that are both safer and more humane.
