Personal Care Products Safety Act Includes Phasing Out Animal Testing on Cosmetics

The Personal Care Products Safety Act is intended to provide more assurance that ingredients and final products sold as personal care products, specifically cosmetics, are safe for humans.

While last session’s bill contained language merely “encouraging,” but not requiring, the use of non-animal alternatives, this year’s bill states that “It is the sense of the Senate that animal testing should not be used for the purposes of safety testing on cosmetic products and should be phased out with the exception of appropriate allowances.”

This language, which is a placeholder for specific language to be added as the committee marks up the bill, must be unambiguous to be effective. The best way to do that is by including the language of last session’s Humane Cosmetics Act (HR 2790) to prohibit the use of live animals to test cosmetics and other personal care items.

The Humane Cosmetics Act language reads: “It shall be unlawful for any entity, whether private or governmental, to conduct or contract for cosmetic animal testing that occurs in the United States and is for the purpose of developing a cosmetic for sale in or affecting interstate or foreign commerce.

“It shall be unlawful to sell, offer for sale, or knowingly transport in interstate commerce any cosmetic if the final product or any component thereof was developed or manufactured using cosmetic animal testing conducted or contracted after passage of this Act.

“The Secretary of Health and Human Services shall assess whoever violates any provision of this Act a civil penalty of not more than $10,000 for each such violation.”

In addition, the Humane Cosmetics Act language would prohibit the sale, after three years, of products tested on animals before the date of enactment.

Please Support Making Cosmetics and Personal Care Products Testing Safe AND Humane

Dear [Decision Maker],

I am writing today in support of legislation, S 726, to ensure that personal care products, including cosmetics, are safe for human use. I'm delighted that this bill includes language to end the use of animals for cosmetics safety testing.

While the final wording is still being finalized, I urge you to support the inclusion of language from last session's Humane Cosmetics Act to ensure the clarity of this prohibition.

Today, all the nations in the European Union, along with many other countries around the world, are adopting laws that will ensure both humane and safe products. Requiring human relevant data--as opposed to animal data--in considering the safety of cosmetics and other personal care products will result in products that are both safer and more humane.
